Vizibeat Refund Policy

This Refund Policy applies to all purchases of Vizibeat subscriptions and related digital products sold by Empa3D LLC (“Empa3D”, “we”, “us”, or “our”) through Paddle, our Merchant of Record.
By purchasing any Vizibeat product, you agree to this Refund Policy.
1. PADDLE AS MERCHANT OF RECORD
Paddle (Paddle.com Market Limited) is the seller of record for all Vizibeat transactions and is responsible for processing all refunds. Refund requests are handled by Paddle in accordance with Paddle’s buyer terms, available at https://www.paddle.com/legal/checkout-buyer-terms. Paddle may refuse refund requests in cases of fraud, refund abuse, or other manipulative behavior.
2. EMPA3D 30-DAY MONEY-BACK GUARANTEE
In addition to any rights under Paddle’s buyer terms, Empa3D voluntarily commits to the following merchant guarantee: within thirty (30) days of any of the qualifying events below, Empa3D will authorize Paddle to issue a full refund on your request, without requiring a reason:
– The initial purchase of a paid Vizibeat subscription (Creator, Pro, or Studio); or
– A Tier upgrade (e.g., Creator to Pro, or Pro to Studio), in which case the refund covers the amount paid for the upgrade and your account is downgraded to the prior Tier.
Refunds are issued to the original payment method, typically within 14 days of the request. Paddle processes the refund and retains discretion to decline in cases of fraud, refund abuse, or manipulative behavior.
You may cancel at any time through the account portal; cancellation takes effect at the end of the current billing period, and you are not charged further.
3. EXCLUSIONS FROM THE 30-DAY GUARANTEE
The 30-day guarantee does not apply to:
– Refund requests submitted more than 30 days after a qualifying purchase listed in Section 2.
– Automatic renewal charges (monthly or annual). To avoid an unwanted renewal, cancel before the renewal date; we send advance-renewal notices for annual Subscriptions as described in Section 7 of the Vizibeat EULA. Renewal-charge refund requests are handled by Paddle on a case-by-case basis under Paddle’s buyer terms.
– Accounts terminated for material breach of the Vizibeat EULA, including unauthorized Commercial Use, circumvention of licensing or watermarking, or violation of the export-control or sanctions provisions.
– Fraudulent purchases, refund abuse, or other manipulative behavior, which Paddle may refuse in its discretion.
4. STATUTORY CONSUMER RIGHTS
Neither this Refund Policy nor Paddle’s buyer terms waive or limit statutory consumer rights that apply under the laws of your jurisdiction of residence, including the 14-day distance-selling withdrawal right granted to EU, UK, and EEA consumers under the EU Consumer Rights Directive and equivalent national implementations (as described in Section 6.1 of the Vizibeat EULA). Where a statutory right is more favorable to you, the statutory right controls.
5. HOW TO REQUEST A REFUND
To request a refund within the 30-day guarantee window, contact Paddle directly through the payment receipt you received at purchase, or email legal@empa3d.com with your account email and transaction identifier. You do not need to provide a reason for requests made within the 30-day window. For requests outside the 30-day window, Paddle handles them on a case-by-case basis under Paddle’s buyer terms.
6. CHANGES TO THIS POLICY
Material changes will be notified to active Subscribers at least 30 days in advance by email and will apply to purchases made on or after the effective date of the change. Purchases made before the effective date remain governed by the version in effect at the time of purchase.
